Design Book Terms of Service

These Terms of Service ("Terms") govern your access to and use of Design Book, a web application for tracking home build, remodel, and single-room design projects (the "Service"), available at designbook-beige.vercel.app, provided by PS Design LLC, a Missouri limited liability company (Entity No. LC014768740) ("PS Design," "we," "us," or "our").

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service. Please also review our Privacy Policy, which explains how we collect and use your information and is incorporated into these Terms by reference.

1. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. By using the Service, you represent that you meet these requirements.

2. Your Account

To use most features of the Service, you must create an account. You agree to:

• Provide accurate and complete registration information.
• Keep your login credentials confidential and not share your account with others.
• Notify us promptly at paigewrightdesign@gmail.com if you suspect unauthorized use of your account.

You are responsible for all activity that occurs under your account.

3. The Service

Design Book lets you track home build, remodel, and single-room projects, including selections by room and category, vendor and status information, budget ledgers, project documents (such as permits, paperwork, receipts, invoices, and floorplans), moodboards, and AI-render-prompt exports.

We may add, change, or remove features of the Service at any time, and we may suspend or discontinue the Service (or any part of it) with or without notice, though we will make reasonable efforts to notify you of material changes affecting paid accounts.

4. Subscriptions and Payment

Some features of the Service may require a paid subscription. If you subscribe to a paid plan:

• Payment is processed by a third-party payment processor. You authorize us (through our processor) to charge your payment method for all fees associated with your plan.
• Subscription fees are billed in advance on a recurring basis (e.g., monthly or annually) until you cancel.
• You may cancel your subscription at any time; cancellation takes effect at the end of your current billing period, and we do not provide refunds for partial periods except where required by law.
• We may change subscription pricing with advance notice. Continued use of a paid plan after a price change takes effect constitutes acceptance of the new price.
• You are responsible for any taxes associated with your subscription.

5. Your Content

"Your Content" means the project information, documents, images, budget data, and other materials you upload or enter into the Service.

• Ownership: You retain all ownership rights in Your Content. We do not claim ownership over it.
• License to us: You grant PS Design a limited, non-exclusive, royalty-free license to host, store, reproduce, and process Your Content solely as needed to provide and improve the Service (including generating moodboards and AI-render-prompt exports you request).
• Your responsibility: You are solely responsible for Your Content and for ensuring you have the rights to upload it (for example, permits, invoices, or floorplans that may contain third-party or confidential information). Do not upload content you don't have the right to share.
• AI-generated exports: When you use the render-prompt or moodboard export feature, output may be generated with the help of a third-party AI/image-generation service based on the project details you provide. We do not guarantee the accuracy, originality, or fitness for any purpose of AI-generated output, and you are responsible for reviewing it before relying on or sharing it.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms.
• Upload content that infringes on the intellectual property, privacy, or other rights of any third party.
• Attempt to gain unauthorized access to the Service, other accounts, or our systems.
• Interfere with or disrupt the integrity or performance of the Service.
• Reverse-engineer, decompile, or attempt to extract the source code of the Service, except as permitted by law.
• Use automated means (bots, scrapers, etc.) to access the Service without our prior written consent.

We may suspend or terminate your account if we reasonably believe you have violated these Terms.

7. Intellectual Property

The Service, including its design, features, software, and branding (excluding Your Content), is owned by PS Design LLC and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or brand features except as necessary to use the Service as intended.

8. Third-Party Services

The Service relies on third-party providers, including Supabase (authentication and database), Vercel (hosting), a payment processor (billing), and an AI/image-generation service (render exports). We are not responsible for the acts, omissions, or availability of these third parties, though we select and monitor them as part of operating the Service.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY BUDGET, SELECTION, OR AI-GENERATED OUTPUT WILL BE ACCURATE OR SUITABLE FOR YOUR PROJECT. YOU ARE SOLELY RESPONSIBLE FOR VERIFYING ANY INFORMATION USED IN CONNECTION WITH YOUR ACTUAL CONSTRUCTION, REMODEL, OR PURCHASING DECISIONS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PS DESIGN LLC AND ITS OWNERS, EMPLOYEES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) $100.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless PS Design LLC from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service, Your Content, or your violation of these Terms.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service if you violate these Terms or for other reasonable business reasons, with notice where practicable. Upon termination, your right to use the Service ends, though provisions of these Terms that by their nature should survive (such as Sections 7, 9, 10, and 11) will continue to apply.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the "Effective date" above and, where appropriate, provide notice through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by the laws of the State of Missouri, without regard to its conflict-of-laws principles, unless otherwise required by applicable law.
